1. Data controller

The controller of your personal data is Motiva sp. z o.o., ul. Szlak 77/222, 31-153 Kraków, Poland, entered in the register of entrepreneurs of the National Court Register under KRS number 0000700134, NIP 6762538020, REGON 368552326.

2. What this document covers

This policy explains how we process the data of people who visit the motivagroup.pl website: the data you send through the contact form, the data recorded automatically in our server logs, and the data collected by means of cookies and similar technologies.

Which basis applies to your enquiry. If you write as a person who would be a party to the contract yourself — for example as a sole trader — the basis is Article 6(1)(b) GDPR. If you write as a representative of a company, on its behalf, the basis is Article 6(1)(f) GDPR, and our legitimate interest is the handling of business correspondence.

4. Cookies and similar technologies

Cookies that are necessary for the website to work are always stored. Analytics and marketing cookies are stored only after you have given your consent — until then we do not load any measurement or advertising tools and we do not store their files.

Consent to analytics cookies and consent to marketing cookies are independent of each other — you may give one of them, both, or neither. Refusing does not limit your use of the website or your access to its content.

You can withdraw your consent at any time using the Cookie settings link in the website footer. Withdrawing consent is as easy as giving it and does not affect the lawfulness of the processing carried out before the withdrawal.

6. Recipients of the data

Data relating to measurement and advertising is transferred to Google Ireland Limited (Gordon House, Barrow Street, Dublin 4, Ireland).

As regards statistics on the use of the website, Google processes the data on our instructions, as a processor. As regards advertising and remarketing, Google processes the data for its own purposes as well and acts as a separate controller — in that case it decides on its own about the means and purposes of the processing.

Data from the contact form is also passed to providers acting on our instructions:

  • Resend — the transactional e-mail provider that delivers the form message to our mailbox,
  • Hetzner Online GmbH — the provider of the server infrastructure on which the website runs and in which the server logs are created,
  • our corporate e-mail provider.

We do not sell data and we do not make it available to third parties for their own marketing purposes.

7. Sharing data within the group

The websites of the Motiva group use a shared measurement configuration, thanks to which moving between our sites is recognised as a single visit rather than several separate ones. The linking is done by means of a parameter passed in the page address when you move between our websites. This means that data about your use of this website becomes part of a set shared by the following companies: Motiva sp. z o.o., Motiva Solutions sp. z o.o., ALB Logistics sp. z o.o., MTEAM sp. z o.o. oraz Euro Cargo Line sp. z o.o..

As regards the joint measurement of website use, the companies of the Motiva group act as joint controllers (Article 26 GDPR). We have agreed that the handling of requests concerning personal data, and the maintenance of the consent settings and of this policy, are coordinated by Motiva sp. z o.o., which you can contact at [email protected]. We make the essence of our arrangement available on request. Regardless of this division of roles, you may exercise your rights against each of the companies separately.

8. Transfers of data outside the European Economic Area

Google and the transactional e-mail provider may process data outside the European Economic Area, including in the United States. Such transfers take place on the basis of the European Commission’s adequacy decision under the EU–US Data Privacy Framework and, additionally, of standard contractual clauses approved by the European Commission.

The entity certified under the Data Privacy Framework is Google LLC; you can verify that the certification is current in the public list maintained by the US Department of Commerce (dataprivacyframework.gov).

9. Profiling

If you give marketing consent, your activity on the website may be used to show you advertisements matched to your interests, including after you leave our site. This constitutes profiling. We do not take decisions about you based solely on automated processing that would produce legal effects concerning you or similarly significantly affect you.

10. Your rights

You have the right to access your data and to obtain a copy of it, to have inaccurate or incomplete data rectified, to have your data erased, to restrict the processing, and to data portability.

Right to object. Where processing is based on our legitimate interest — that is, handling correspondence from the form and keeping server logs — you may object at any time on grounds relating to your particular situation. A message to the address given in section 1 is enough.

As regards data processed on the basis of consent, you have the right to withdraw it at any time, in the manner described in section 5.

You also have the right to lodge a complaint with the Polish supervisory authority: the President of the Personal Data Protection Office (Prezes Urzędu Ochrony Danych Osobowych), ul. Stawki 2, 00-193 Warszawa, Poland.

11. Whether providing data is voluntary

Providing data in the contact form is voluntary, but it is necessary for us to be able to answer your enquiry. Giving consent to analytics and marketing cookies is entirely voluntary and is not a condition of access to the website or to its content.

12. Changes to this policy

We may update this policy. Date of the last change: DATE. Changes that materially affect the scope of processing based on consent require that consent be obtained again.

13. Language versions

This policy is published in several language versions (pl, en, da). In the event of any discrepancy between them, the Polish version shall prevail.
